Open access for publications under H2020

I would like to ask if somebody has experience with the open access publication agreement required under the Marie Curie Fellowship scheme/H2020.

The European Commission provides a template to be discussed with the publishers of journals https://ec.europa.eu/research/participants/data/ref/h2020/other/hi/oa-pilot/h2020-oa-guide-model-for-publishing-a_en.pdf in order to agree on a green open access with max 6/12 months embargo before making the article publicly available.

My questions are:

1) what happens if the publisher does not agree to such request?

2) are there specific funds that we can access to pay for the gold open access fee?

The issue I foresee is that if we always need to end up paying for the gold open access fee, it can become very expensive if the project is successfull in producing a lot of papers.
