Regardless of the outcome of the process, it will hardly have any consequences for the academics who have allegedly manipulated the selection process. There have been dozens of similar cases, the most the justice can do is to repeat the selection process. The unjustly treated person spends enormous sums of money, has to wait for years and only manages to be able to apply again, and sometimes the result of the election is repeated despite having been a judicial process in between.Unfortunately, this is the rule and not the exception in the Spanish academic system.

I have worked in France, Venezuela and other Latin American countries, and the result that Francisco José Eiroa-Orosa talks about is unfortunately common in all those places. These are vices of the academy that seem to be standardized.

The recent case is from the Madrid circle, however, no different exception are expected also regarding the other many EU countries. The time-factor of such cases normally works in favor of the systemic abusers, as well as, also, the exclusive possibility of being able to claim the administrative procedure in many cases, and not the merits. This and many other cases with no substantial response received. To implement a firm change in such a structural area of the academic system will require an evolutive-type of approach in base of a colective effort and encouragements of people capable both personally and resourcely to face it legislatively.

Hello dear colleagues, 

 

I am Croatian - besides my surname (married to a Spaniard) and I live near Madrid for the past year and a half and have to say that I have encountered similar situations in the Western Balkan region and in Italy. Corruption is a normative there. 

I just wanted to add that I have tried to apply for the "Serra Hunter" programme of Catalonia which is promoted to attrack foreign talents by various platforms such as EURAXESS, Academic positions etc. but all the positions where at the end given to the staff already working at the Universities and they even asked me for an interview in Spanish and to learn Catalan in 2 years (level C1) although the positions where not advertised as such.

That is a pity to hear that about the "Serra Hunter" programme, due to having the Selection Commitees practicly formed by the international and even intersectoral members (that can be all consulted on the web site). Also the 50/50 funding mode should benefit a sound academic selection procedure in this particular case. The obligation of publishing the calls for academic jobs became mandatory in Spain with time being a kind of a pioneer improvement.

yes, this is an example of institutionalized bullying, turning the eye away is a coming proceeding. I have been dealing with this in France and the USA, institutions know exactly what had happened to me but they just systematically ignoring my emails. A kind of meTooSTEM movement have to be iniciated, to make public that there are also "sheriff" in the academia that can do anything they want.

Dear Friends,

 

I have recently suffered the same deception like all of you at University Rey Juan Carlos in ESCET, MADRID.

Unfortunately, my deception has been double. 

The first one has been to be witness to the perversion of a CV scale by the evaluating commission in order to select their preferred candidates. Quiet ridiculous perversion, by the way!!

The second one, and this is much much more important, is that this scale perversion has been materialised by relative young people like us (40-45 years old). Few years ago, these academics complained about the system, when they were the victims. Now, in a great opportunity to start rebuilding the selection process for academics at university, they simply thought in their personal interests and broke the rules, with the subsequent lost of talent at my institution.

 

This is very disappointing and clearly revealed the value and ethics of these again corrupted and measly academics.

 

It is our hands star changing the system and when one of us have the opportunity to be in a selection process, we must think in all these reflections!!

From the quantity of responses here, it seems this is a serious problem throughout Spanish academia. I think it is further exasperated by a very weak, unappealing private sector, that cannot attract/absorb highly qualified talent, and by the fact that Spain (at least in my view) is still quite a closed and family-oriented society, where you take care of your own people (ie PhD students).
Im wondering if it will be of interest to write a short letter to a journal to tell about our perspective as Marie Curie Alumni, because I think the persistent selection of mediocre candidates perpetrates the problem and damages spanish academia.

I agree. The point is where to aim our complaints, suggestions... Because this is an open secret. I consider the minister of education, ANECA, General Director of Universities... But that the Marie Curie alumni could express that, doesn't sound bad to me, since we are recognized (but, don't confuse this, for the same reasons we're exposing here, you'll be necessarilly hired by a University after your contract). I'm open to talk abou that in private if you consider.

It seems that the commented subject belongs to the academic environment in Madrid, several international cases are actually commented here, confirming this is not only the Spanish academia problem. The other additional perspective, for being both unique regarding the contracting conditions and temporary, will be also the experience of a Marie Curie fellow within the commented institutional systems.

Dear colleagues,

Well... In this regard I don't know where to start to tell you my experiences. Ikerbasque, several Spanish Universities once and again... Frustrating. I don't state they don't exist, but, always in my experience, I almost haven't seen a single clean contest (in fact, I don't remember any in my field). If you read the list of candidates and see some names that are 'the fellow of...", 'the pupil of...', you most probably know who will be given the post, regardless CV and merits. I saw this hundred of times and it happened to me hundred of times. In my experience, even denying I had a PhD, that I didn't present some specific papers -so I had to send them again, to prove it again... when the clock was ticking against me-, trying to turn my merits in demerits -many of them the members of the committee didn't had-, not considering my merits properly, directly not keeping the contest rules they had published, ignoring them, giving the post even a candidate that was not the profile required, etc., etc., etc. Hundred of times. When you present your claims, obviously, they make up what they want, saying that was a clean contest, protected by the institution. The point is when you claim or report it, you don't go against the corrupt member of a committee, but against the institution itself. If you report them, the point is, such institution will protect them, you don't want anything because, first, you should win the trial (and judges ussually don`'t go against institutions and tribunals, that's a very sad reality), but then in case you win, the post is not given to you, but the constest has to start again, from the scrach, so nothing happens to the corrupts, it's free for them.

I make just one single example of many I could tell. At a Spanish university we concurred at the same contest candidates with very strong CV's, with international experience and contracts (Marie Curie, like me, another candidate had had a grant at Harvard, another one prestigious ones in Japan and USA...)... Well, the post was given to the 'home candidate', who never had gone out of the region (in this case Asturias), with only regional studies, not internationally recognised, etc. Well, even a member of the committee thought it was illegal and reported why many times to the University authorities. To make the long story short, just to say that the university itself, after different claims by the candidates and such member of the committee, recognised there were irregularities and called a one (I'm trying to be concise, but this lasted two years), but that 'new' one was made up with three from the old one, so... Fine, the member of the committee that said there were all irregularities, reported them to the office of the public prosecutor, who considered that yes, there were evidences of a crime. Well, such office sent them to a court (a file of about 70 pages describing presumed crimes), and of all such presumed crimes and people involved, the judge just investigate two people by calling three of the harmed candidates to state. Besides, all of the presumed corrupts weren't investigated either all the presumed crimes contained in the report of that the member of the committee were answered. Fine, those investigated said they had rejected in time to be part of that second jury (that the candidates didn't know, they weren't told if that was true) and then the judge dismissed the case. As I've said, I've been very brief. By the way, the same judge that found not guilty the vice-chancellor of the same university some months later in a similar case of presumed corruption.

En lo que hace al punto fuerte, expongo lo que comentaba el otro día en un grupo menor... Los casos de nepotismo y prevaricación en la adjudicación de plazas de las universidades en España no es ningún secreto. La cuestión es que por tales casos, muchos investigadores de valía -con contratos incluso de elite internacional, publicaciones, delegaciones internacionales....- se ven obligados a emigrar, quedándose en las universidades españolas aquellos que, por ser amigos de o familiares, aunque no tengan méritos suficientes (hay que ver las acreditaciones de la ANECA, que parece que no todas son muy "justas", por así decir), se les conceden plazas. Como acabo de comentar, hace unos meses aparecieron los rankings de universidades del mundo y España bajó en los mismos. Para mí esta es una de las razones principales. Como me tienen dicho en varias ocasiones, te queda el recurso de las demandas y denuncias. Qué ocurre aquí, pues que la institución defenderá los nombramientos a pesar de ser irregulares (incluso contraviniendo sus propias bases). Entonces lleva tiempo y dinero. Pero, en caso de ganar un pleito, lo más probable es que haya recursos y luego otras argucias para seguir con su favorito (por así decir), con lo que te puedes plantear tener que volver a denunciar entrando en un círculo vicioso. Un profesor de Alicante (hablo de memoria y me puedo equivocar, pero lo puedes comprobar) creo que estuvo once años así. Es una baza para los corruptos por la que el 90% de los afectados no denuncia. ¿Cuál sería la solución? Aparte de una renovación del sistema universitario de arriba a abajo para evitar clientelismos, cortar la cabeza a la serpiente. Es decir, que los pleitos y penas en su caso recaigan en las personas que cometieron la irregularidad o delito. ¿Por qué? Porque en estos casos, lo común es que no se litigue únicamente contra unos miembros de un tribunal que cometieron un acto de prevaricación, si no que se puede entrar en una cadena de encubrimientos y falsedades que puede llegar hasta la cabeza de la Universidad. Hay un hecho claro: en la Universidad española se pueden cometer estas irregularidades porque las personas que las hacen no es en su nombre, sino bajo un paraguas institucional que los protege. Esto es, si cometen una irregularidad, la propia institución intentará cubrirlo y, en caso de que se lleve a un contencioso y pierdan, esas personas en concreto no se ven afectadas, pues sería contra la institución, un colchón que los protege a ellos aunque sean los responsables y, por tanto, es "gratis". Te aseguro que casos no faltan. Ya ves el ejemplo de los presuntos casos de la Universidad de Oviedo. Uno ya apareció en la prensa local por una concesión de plazas en Geológicas, pero hay otro en el Departamento de Historia que, a mi juicio, es incluso más claro de (presunta) prevaricación, ateniéndome a los méritos de los candidatos y lo reflejado por escrito por un miembro del propio tribunal y uno de los afectados en su reclamación. Es tan irregular que un miembro del tribunal (el que me acabo de referir), presentó varios escritos de queja reflejando (presuntas) gravísimas irregularidades -yo diría que incluso hasta burdas por su descaro, en la confianza que otorga la impunidad- en la concesión de la plaza, otro miembro del tribunal se desentendió del asunto y el propio sindicato también reflejó irregularidades. En suma, de 5 miembros de ese tribunal más la representante sindical, sólo firmaron el acta de concesión los tres miembros que concedieron la plaza. Aparte, insisto, de las reclamaciones de aquel miembro del tribunal, presentaron reclamación... tres afectados de siete... De verdad que si ves el expediente verás el descaro, porque no puedo aquí reflejarte todas las (presuntas) irregularidades (hablando suave) que aparecen en él... y esto, podríamos decir, es común en el sistema universitario español.

Las consecuencias no son sólo que se enchufe a un "favorito", no. A mi juicio son muchas más. Las más evidentes son que se resiente el sistema de calidad de la Universidad y la fuga de cerebros, con lo que luego no nos podremos quejar. Pero, por otro lado más personal, puede llevar a que muchos investigadores de valía deban abandonar su carrera (con los años de esfuerzo que tengan detrás, que se convierten en nada), dedicándose a profesiones que en absoluto tengan que ver con aquello en que se formaron y los esfuerzos (tiempo y salud) invertidos sean una pérdida de tiempo. Y no sólo eso, ya que esas personas corruptas influyen no únicamente en aquél que rechazaron teniendo más méritos y calidad, sino en sus familias. Una persona no es únicamente ella, sino las personas que están ligadas a él o incluso dependan de él (parejas o hijos, por ejemplo). Para no aburrirte, por último, decir que no tiene sentido que te digan del Consejo de Investigación de la Unión Europea (con los rigurosos filtros académicos que tiene) o una universidad de elite que les interesas tú y tus proyectos y una universidad de provincias prefiera a un candidato que simplemente lo es por no haber salido nunca de allí. Permíteme el ejemplo de decir que es como si eres futbolista y el Real Madrid o Barcelona te dicen que eres bueno pero el de tercera regional prefiere al vecino que jugaba en el parque del pueblo simplemente porque es del pueblo, aunque no le dé al balón. Ahora es posible que pienses que, si es así, debería incluso alegrarme. La respuesta es que significa una especie de exilio, alejarse de la familia y seres queridos, de tu medio natural. Mi experiencia (pues, como sabes, llevo años fuera de España), es que el dinero no lo es todo, ni el prestigio académico; lo primero es mi familia. Si trabajas duro (en un ambiente no corrupto), siempre se avanzará estés donde estés y, al contrario, esa universidad "pequeña" debería alegrarse y valorarlo, no al revés. Pero esto no se lo plantean quienes cometen las irregularidades, que entiendo, cuando menos, necios por no darse cuenta de sus actos y mediocres por la misma razón. A mi juicio tienen los valores del bien y del mal alterados y, al contrario, creen que hicieron algo muy bueno por dos razones:

a) Aunque se vaya el amo, queda su perro. Es decir, sería tanto el caso de aquellos que se puedan jubilar dejando a su esbirro en una manera de “estar ahí” aunque no sea físicamente, o aquellos que quieren un vasallo para obrar en el Departamento, que no les cuestione y haga lo que “debe hacer”. En estos casos, lo común es que tales vasallos tengan incluso menos calidad de aquel amo que los ungió, porque a alguien con tal mediocre personalidad no le gusta que le hagan sombra.

b) Ante tal alteración, entender que ayudaron a un amigo y, por tanto, cometieron (en cursiva) una buena acción. Obviamente, no se plantean a quién o cuántos perjudican.

A todo esto, por si fuera poco, debemos sumar la pérdida de la calidad de la enseñanza en general. Cómo se llega al Bachiller y se aprueba con la ley del mínimo esfuerzo. Y esos chavales serán los profesores y profesionales del mañana, los referentes... Pues nada... 2+2=4 (hasta que los hijos o nietos de la ESO hagan un debate y discutan las leyes matemáticas por no ser muy "democráticas").

Es evidente que no soy el único que plantea estas cosas, que no dejan de ser un secreto a voces, no corregido por el interés miope y mediocre de los interesados. Pongo algunos ejemplos:

I spent many years in different academic and scientific Spanish institutions and almost each professional I could approach on the personal level could comment similar testimonies as this, including my own as well. Up to the point that (beyond the contest areas) it can be advisable to not to mention some of the merits, the PhD included, in order to have "less problems" on the interpersonal levels. Not only the contest for a job position can be unclear. An individual can be injured regarding the personal status and even family connections, especially if it is a person "not meant to entry" by the group of current influence. Unfortunately the doctoral studies do not guarantee a personal culture and not always ubiquitous envy and greed can be properly channeled on the personal level or in a responsible manner so as not to harm oneself and then others in consequence. And all that can be confirmed for both 3 euros as well as for 3 million euros of the budget.
