leaving the country before end of contract

Dear all,

I would like to know if it is possible to live outside the UK (while having an address) few months before the end of MSCA contract. This would be due to pregnancy and to the need to reunite with family (child and husband).

Hi,

I was in pregnancy at the beiginning of my contract. I suspended it for 6 months and I returned back to my home country for my child delivery. Then, I moved to UK when I re-started my contract.

Hi Silvia,

Thank you for this information. Suspending your contract meant not accessing your right for a maternity leave with 90% of your salary. I guess that you were not paid during the time of suspension?

Hi Meriam,

 

Yes, I was not paid during my suspension and I did not receive any paid maternity by the UK Government. 

Recently, I asked for the reimbursment of some medical treatment I had before and afther my son's childbirth but these cost were not reimburse as my contract was suspended.

Hi Meriam,

In general, a MC Fellowships carry statutory employment entitlements in the UK.  However, there maybe differences in relation to maternity leave depending on the university’s policy. All this information should be written in the supporting documents to your contract. Also, you can suspend your contract as suggested above. It will allow you to come back after some time and continue your fellowship without losing any time at least.

Hi Yana,

Thank you for these details. Indeed, this is what the administration told me. I have a right to a maternity leave. But, as I plan not to reside in the UK after the fellowship I don't think that I want to benefit from the maternity leave. I might just end my contract normally and require a transfer of benefits.

Hello all,

I was shocked at the little guidance and support in this matter. Meriam, I am basically in the same situation as you right now - and I moved to my partner and continued my work from home (as there is little difference whether I write on the PC in the office in the UK or my home laptop)... however, this is in no way an "official" solution and will depend on your host supervisor and the details in the contract.

Whether a suspension is necessary in your case (close to end of contract) - I don't know. You will have to return to the UK to finish the contract after you maternity leave then, which will again disrupt your purpose to reunite with your family. I asked the EU, if in such a case it is possible to change the host institution (while continuing the same project), and the answer was a copy&pasted paragraph from the grant agreement that no transfers are possible for personal reasons... so much for supporting women's careers.

@all: How did you handle the medical billing side of things? Did you just use the European Health Insurance Card while in your home country?

Hi Anastasia,

This gap/no man's land between the EU legislation and requirement and the functioning of each country is really confusing. As I want to leave the UK and pursue my career elsewhere, I might decide to finish my contract and not ask for a suspension or a maternity leave which I am entitled to.

Regarding the medical billing, I am still waiting for my french medical insurance card in order to be reimbursed from my visits to the doctors. All the other costs (blood tests and all tests related to my pregnancy) are not charged. I am lucky enough. Yesterday, I did a trisomy 21 test that normally costs 390€ but I was not charged. I cross my finger to receive in time my card and ask for reimbursement of all my medical costs.
